Thanks, Jonathan. That’s a very helpful posting by Tim Lee. I share his distrust of “class action suits” of this sort. The agreement was a bad solution to bad situation; there should be no problem at all with scanning and making available out-of-copyright materials (or perhaps for those for which no copyright holder is identifiable after a good-faith search).

I wonder if the wizards at Google are self-aware enough to realize the irony after their history of consistent support for big government.
